Welcome to Maesot Market. These Terms of Service ("Terms") govern your access to and use of the Maesot Market website, account features, and purchases (collectively, the "Service"). By creating an account, placing an order, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

Maesot Market ("we", "us", "our") is a cross-border retailer that sources Thai and Burmese goods from Mae Sot, Thailand, and ships them to customers located in the United States.

2. Eligibility and accounts

  • You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or place an order.
  • You agree to provide accurate, current, and complete information and to keep it up to date.
  • You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
  • We may suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently.

3. Orders, pricing, and acceptance

  • All prices are shown in US dollars and exclude any duties, taxes, or fees unless stated otherwise.
  • Placing an order is an offer to purchase; we may accept or decline it at our discretion. A contract is formed only when we confirm acceptance, typically by sending an order confirmation email and processing payment.
  • We try to keep product descriptions, photos, and prices accurate, but errors can happen. If we discover a material error in an order you have placed (such as a wrong price), we will contact you and either correct the order with your consent or refund it in full.
  • Product availability is not guaranteed. Some items are made or sourced on demand and carry a lead time disclosed at checkout.

4. Payment

Payments are processed by Stripe. By submitting payment information you represent that you are authorized to use the payment method and you authorize Maesot Market and Stripe to charge it for the order total, including any shipping fees and applicable taxes. We do not store full card numbers.

5. Shipping and delivery

  • We offer two shipping modes: standard (consolidated DHL shipment to our US handler, then domestic USPS/UPS/FedEx to you) and special (DHL direct to your door).
  • Delivery time estimates are best-effort and not guaranteed. International transit, customs clearance, weather, and carrier delays can affect timing.
  • Risk of loss and title pass to you when the carrier delivers the package to the address you provided. Please confirm your address is correct before checkout — re-routing or re-shipping after dispatch may incur additional fees.
  • You are responsible for any import duties, taxes, or customs fees imposed by your destination country. Where applicable these may be collected at checkout or by the carrier on delivery.

6. Returns, refunds, and damaged goods

  • Perishable, food, and personal-care items generally cannot be returned for health and safety reasons.
  • Non-perishable items may be returned in unused, original condition within 14 days of delivery, subject to inspection. Return shipping is the customer's responsibility unless the item arrived damaged or incorrect.
  • If your order arrives damaged, defective, or missing items, contact us within 7 days of delivery with photos. We will replace, refund, or credit at our discretion.
  • Refunds are issued to the original payment method and typically appear within 5–10 business days after we process them.

7. Bulk requests

Bulk-request quotes are valid only for the specific quantity, price, and expiry date stated. Approval of a quote creates a binding order, and a payment link will be issued to complete the purchase. Quotes that expire without approval are void.

8. Acceptable use

When using the Service, you agree not to:

  • Use the Service for any unlawful purpose or in violation of any export-control, sanctions, or import regulations.
  • Submit false, misleading, or fraudulent orders, payment details, or contact information.
  • Resell products purchased from us for commercial distribution without our written permission.
  • Attempt to interfere with, probe, scrape, overload, or disrupt the Service or its security features.
  • Upload content that is unlawful, infringing, defamatory, obscene, or harmful.
  • Impersonate another person or misrepresent your affiliation with anyone.

9. User-submitted content

When you submit images, requests, or other content through the Service, you grant Maesot Market a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and use that content as reasonably necessary to provide the Service and respond to your requests. You represent that you have the rights to submit the content and that it does not violate any third-party rights.

10. Intellectual property

The Service, including its design, text, graphics, logos, product photos, and software, is owned by Maesot Market or its licensors and is protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent, except as permitted by law.

11. Third-party services

The Service relies on third-party providers (such as Stripe, DHL, Cloudinary, Resend, Google, and Facebook). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the availability, content, or practices of third-party services.

12. Disclaimers

The Service and all products are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. Nothing in these Terms limits any warranty that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, Maesot Market and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with the Service. Our aggregate liability to you for any claim arising out of or relating to the Service or any order is limited to the amount you paid us for the order giving rise to the claim, or one hundred US dollars (US$100), whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless Maesot Market and its owners, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

15. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Thailand without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the competent courts of Mae Sot, Thailand, unless local consumer-protection law gives you the right to bring proceedings in your country of residence.

16. Changes to the Service or these Terms

We may modify or discontinue any part of the Service at any time. We may also update these Terms from time to time; when we do, we will revise the "Last updated" date above. Material changes will be communicated by email or through a notice on the site. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

17. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Maesot Market regarding the Service.
